Network Perspective (“We”, “us” or “our”) provides tools commercialized as “Network Perspective application or website” to help companies create their organizational charts by sharing information about cooperation among employees. Our Service is tailored for professionals and we do not leave B2B zone. We understand the importance of protecting information. For this reason, Network Perspective strives to have business procedures and security safeguards in place to protect information under its control. The column on the right (named “Basically”) provides a short explanation of the terms of use and is not legally binding.

We are Network Perspective, and we create an application that helps companies manage collaboration among employees.

Scope and Application

This Privacy Policy (“Policy”) is intended to establish responsible and transparent practices for the management of information (i.a. personal and confidential) and to satisfy the relevant and applicable legal requirements. This Policy sets out the standards, responsibilities and obligations of Network Perspective in respect of information collected, accessed or processed by Network Perspective in the course of its business operations and specifies the obligations of Network Perspective that arise also from our General Terms (available at https://www.networkperspective.io/#/terms) (the “General Terms”) entered into between Network Perspective and its corporate customers (each, a “Customer”), whereby we might handle or have access to information. This Policy also governs information collected about Network Perspective’s website Users and explains how Network Perspective uses information collected from people who visit its website and otherwise interact with Network Perspective through https://networkperspective.io/ and its sister websites provided by Network Perspective (for example, https://www.networkperspective.io/#/privacy) (collectively, the “Website”). It also explains the use of cookies and similar technologies. The Customer states that all its Users know and accept General Terms and Privacy Policy. These Privacy Policy and our General Terms (together, the Agreement) form a contract between you and Network Perspective Sp. z o.o. Located in Europe, Poland, H. This policy describes the way we handle information.

Definition of Personal Data

Personal data is defined as “any information about an identified or identifiable natural person” (see General Terms, Choice of law, Jurisdiction and Venue). This may include, for example, email addresses and contact details and any similar information provided to Network Perspective in the course of its business operations or which Network Perspective may receive from business inquiries. Personal data that is aggregated and cannot be associated with an identifiable individual is not considered to be personal data.

Basically:

Personal data is information about an individual that makes him or her easy to identify (e.g. e-mail).

How do we use the information we collect?

Use of Personal Data

When providing Services (all definitions as in General Terms), Network Perspective as to the rule does not process personal data (and is not an administrator of personal data) but only makes its software available for the Customer, who may happen to process these information (and be the administrator of personal data); in such case Customer shall notify us. The Customer obliges itself and it assures Network Perspective that it will comply with all relevant legal provisions and if necessary – provide information and collect consents from the Users. The Customer states that all its Users know and accept General Terms and Privacy Policy. In order to carry out the implementation (in situations where this is the case), the Customer entrusts us, under the conditions specified in art. 31 of the Act of 29th August 1997 on the Protection of Personal Data ("SPPD") and on the conditions specified in art. 28 of Regulation (EU) 2016/679 of The European Parliament and of The Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (“GDPR”), processing of Users' Personal Data on the following conditions:

  • categories of data subjects: internal stakeholders, in particular employees of the Customer;
  • type of personal data: ordinary data in the scope: first name, last name, position, team, organization department, location of the workplace, department, competences, duties;
  • the purpose of processing: mapping the cooperation network and providing feedback in the organization;
  • duration of processing: for the duration of this contract;
  • nature of processing: in the electronic system, i.e. using software called the "Network Perspective".

The Customer remains the sole administrator of Personal Data that will be entered into the software. The Client represents and warrants that he has the appropriate legal basis and consent (if legally required, in particular on the basis of the GDPR) of persons whose Personal Data is to be processed, for the processing of Personal Data by means of software and for entrusting us with their processing. The Customer exempts us from all information obligations towards persons whose Personal Data will be processed under this Agreement and the Customer undertakes to fulfill these obligations on his own - under pain of all liability provided by the relevant provisions of law, and under pain of liability towards us. The processing of Personal Data by us is only permitted for the implementation execution of the provisions of the Agreement and only to the extent necessary to achieve the purpose of this Agreement. The Customer, as the administrator of personal data, entrusts us and orders us (and within our structure, in particular, Ms Anita Zbieg, PhD) to authorize, on behalf of the Customer, to process Personal Data of the employees / subcontractors employed by him and keep records of these persons, in accordance with art. 39 SPPD. The Customer accepts that we may use the services of another data processor (sub-processor), and also authorize our employees or persons cooperating on a basis of a civil contract to process the Personal Data entrusted by the Customer. In this case, the sub-processor and the authorized person have the same obligations to protect Personal Data as we do. What's more, we are responsible for the negligence of the sub-processor and / or the person authorized by us as for our own activities. We undertake to take the following steps to protect the Personal Data obtained from the Customer: to perform supervision over data security throughout their possession in a manner that ensures in particular protection against unauthorized access, damage, destruction or loss, to use appropriate technical and organizational measures to ensure confidentiality, integrity, availability and security of the system in which Personal Data will be processed, i.e. software; delete all data immediately after performing the subject of this Agreement. The Customer has the right to carry out inspections and audits at any time regarding the protection measures applied to processing of Personal Data. We will inform the Customer of any breach of obligations arising from these provisions without delay, no later than within 2 working days from the date of finding the violation. We will help the Customer - through appropriate technical and organizational measures - to meet the obligation to respond to the requests of the person whose Personal Data concern, in the exercise of the rights of that person set out in the relevant legal provisions. Taking into account the nature of the processing of Personal Data and information available to us, we help the Customer - only to the extent related to the performance of this Agreement - to fulfill his obligations regarding the protection of Personal Data imposed on the Customer by law. Only to the extent related to the exectution of this Agreement, we will provide the Customer with all information necessary to demonstrate that the Customer fulfills the obligations regarding the protection of Personal Data arising from the law, including in particular art. 32 GDPR. If our activities related to the above-mentioned assistance activities involve a significant amount of work, we are entitled to receive adequate remuneration for such activities. In case of violation of SPPD’s and GDPR’s provisions in the performance of this agreement, we can we held liable. In case Network Perspective processes personal data it always happens in accordance with the General Terms and the law, in particular SPPD and GDPR. Network Perspective may generally use personal data from or about its Customers and Users for the following purposes:

  • to create, establish and administer Customer’s account, to respond to Customer’s inquiries related to its account and to contact Customer about Network Perspective’s services or account-related matters;
  • to provide services, including to provide Customer and its Users with access and use of the Network Perspective platform and customer support;
  • to measure and analyze User behavior in order to, among others, monitor, maintain and improve Network Perspective’s services or features and to create new services or features;
  • to personalize or customize the experience when using the services;
  • to meet legal and regulatory requirements and to allow Network Perspective to meet contractual requirements relating to the services provided to Customer;
  • to conduct surveys on the quality of Network Perspective’s services or to collect feedbacks on the services; and
  • newsletters and marketing purposes – to provide Customer with offers for additional products and services that Network Perspective believes may be of Customer’s interest.

At any time, the relevant person has the right to object to the processing of his or her Personal Data, requesting their transfer, deletion or modification, in particular by means of a message sent to the address support@networkperspective.io. We may also use information provided by Customers and Users to create de-identified data aggregated for benchmarking or marketing purposes. Such de-identified, aggregated data may be used also after termination of Agreement. Unless required or authorized by law, Network Perspective will not use Customer’s Personal Data for any other or new purpose without obtaining prior consent. We do not use your employees' data for marketing purposes, but if you ask us to send you an offer, we will send it to the email address provided to us. We also have a newsletter that you can sign up for and unsubscribe from.

Basically:

We use information for two main reasons.

Firstly, we provide and personalize the services in applications (e.g. create account). Secondly, we de-identify and aggregate data for benchmarks (e.g. to show how your company performs compared to other companies).

We never use your employees' data for marketing purposes.

If you ask us for a sales offer, we will send the offer to the email address you've provided. We also have a newsletter that you can subscribe to.

Email Communication

We pay great attention to your privacy and we will never share your email address with a third party without your express consent, as described in the heading "Use of Personal Data". We can send emails with invitations, research questions and follow ups, news, products and explanatory videos. If you do not want to receive emails, send us a message to support@networkperspective.io. Remember, however, that you will still receive all kinds of system emails from us (eg regarding forgotten user passwords) and legal notifications (eg updates of the Regulations or the Privacy Policy).

We respect your time and send you only system emails (e.g. forgotten passwords), notifications (e.g. you have been marked as a co-worker), news, and video tutorials

How do we collect the information?

When you give it to us or give us permission to obtain it

Network Perspective generally collects and uses Personal Data from or about its website or application Customers and Users as follows: information provided by Customers or Users. In some cases, Network Perspective collects Personal Data directly from Users when they visit or use the website or application. For instance, Network Perspective may collect the following types of information:

  • Users’ name, contact information, e-mail address, department, position and any other information provided while importing excel file with employees data;
  • Users’ workmates and mentors, as well as photo, areas of expertise and any other information provided by Users by responding to the surveys built into the Network Perspective Application;
  • Inquiries and Requests for a Trial or Service. Network Perspective may collect Users’ name, contact information, e-mail address and any other information provided when Users make an inquiry or contact Network Perspective through the website, when Users sign up to receive Network Perspective’s newsletter or when users submit a request or an order for an Network Perspective trial or service. Network Perspective will only use this information to process and answer Users’ request or to manage Network Perspective everyday business needs in connection with such request;
  • Personalization of application or website. When Users visit the website, they may, from time to time, be invited to provide information such as User’s title to help Network Perspective personalize or customize the User’s experience when using the website.

Basically:

The organizational charts built with our tool are created in two steps. First, your administrator (e.g. HR specialist) imports information about the formal structure of your company (e.g. Excel file with your name, position, and department). Next, you are invited to the application and asked to share information about the workmates you collaborate with. These are the two main sources of information used.

We get technical information when you use our products

Network Perspective generally collects and uses information from or about its website or application Customers and Users as follows:

  • Technical information. When Users visit the website or the application, Network Perspective may collect, using electronic means such as cookies, technical information. This information may include information about visits to the website, including the IP address of the Users’ computer and which browser was used to view the website, the Users’ operating system, resolution of screen, location, language settings in browsers, the site the User came from, keywords searched (if arriving from a search engine), the number of page views, information entered, advertisements seen, etc. This data is used to measure and improve the effectiveness of the website or enhance the experience for Users. While most of the time this information is depersonalized, if this information relates to an identifiable individual (which is strongly unlikely), Network Perspective will respect that and treat this information as personal data. Network Perspective may also, without limitations, collect and use the following type of information when users visit or interact with Network Perspective on the website:
  • Google Analytics: Network Perspective uses Google Analytics which allows it to see information on User website activities including, but not limited to, page views, source and time spent on our website. This information is depersonalized and is displayed as numbers, meaning that it cannot be tracked back to individuals. Users may opt-out of Network Perspective’s use of Google Analytics by visiting the Google Analytics opt-out page;
  • HubSpot and alike services (detailed description can be found on their webpages): Network Perspective uses such selling and marketing tools when someone provides us with contact data and asks to send commercial information, i.a. via form on webpage;
  • Google AdWords: Network Perspective uses Google AdWords Remarketing to advertise Network Perspective across the Internet and to advertise on third party websites (including Google) to previous visitors to the website. AdWords remarketing will display ads to Users based on what parts of the Network Perspective website they have viewed by placing a cookie on the Users’ web browser. It could mean that Network Perspective advertises to previous visitors who haven’t completed a task on the site or this could be in the form of an advertisement on the Google search results page, or a site in the Google Display Network. This cookie does not in any way identify the User or give access to the Users’ computer or mobile device. The cookie is only used to indicate to other websites that the User has visited a particular page on the website, so that they may show the User ads relating to that page. If Users do not wish to participate in Google AdWords Remarketing, they can opt out by visiting Google’s Ads Preferences Manager.
  • Choice with cookies. Users can block the use of cookies by activating the settings in their browser. The “Help” feature on most browsers will precisely guide Users how to prevent their browser from accepting new cookies, how to have the browser notify the Users when they receive a new cookie, or how to disable cookies altogether. If Users choose to withhold consent, or subsequently block cookies, it may be technically impossible to use all features of Services. Additionally, Users can disable or delete similar data used by browser add-ons, by changing the add-on’s settings or visiting the website of its manufacturer;
  • Privacy Policies of other websites. This Policy only addresses the use and disclosure of information by Network Perspective. Other websites that may be accessible through the website have their own privacy policies and data collection, use and disclosure practices;
  • Personal data from other Sources. Network Perspective may obtain from third parties additional personal data about a website user if such user gave permission to those third parties to share its information.

Basically:

Some technical information such as your registration and user profile data are collected as well. Our servers gather log information used to make the website faster and better. To remember you, our website will give you a cookie, which is completely safe. Third-party services that help us analyze how our site is used also use cookies to collect information about visitors to our site. We use only trusted third-party services (like Google).

When you use the application, a little data is collected. When you browse our website, more tools are used.

Data related to traffic on the website and application is not combined to ensure the privacy and anonymity of your employees.

How and when do we share information?

Information Sharing

Network Perspective will not sell, rent or trade personal data to any third party. However, we may share personal data when authorized or required by law or as follows:

  • Service providers. We may grant access to personal data to third party service providers in connection with the performance or the improvement of its website and services. Before sharing any personal data with any third party service providers, we will ensure that the third party maintains proper data management practices for maintaining the confidentiality and security of personal data and preventing unauthorized access;
  • As permitted or required by law. We may disclose personal data as required by applicable law to authorized authority. We may also disclose data to accountants, auditors, agents and lawyers in connection with the enforcement or protection of legal rights. Network Perspective may also release certain personal data when it has reasonable grounds to believe that such release is reasonably necessary to protect the rights, property and safety of others and itself, in accordance with the law;
  • Business transaction. We may disclose personal data to a third party in connection with a sale or transfer of business or assets, an amalgamation, re-organization or financing of parts of our business. However, in the event the transaction is completed, personal data will remain protected by applicable data protection laws. In the event the transaction is not completed, Network Perspective will require the other party not to use or disclose the personal data received in any manner whatsoever and to delete such information.

Basically:

We will not sell, rent, or trade personal data collected with the application to anyone.

Organizational charts you build with us are the sum of information displayed on business cards of your company employees, and we will show this information to other employees within your company network.

Information Security

Network Perspective will store and process the personal data in a manner consistent with industry security standards. Network Perspective has implemented technical, organizational and administrative systems, policies, and procedures to help ensure the security, integrity and confidentiality of personal data and to mitigate the risk of unauthorized access to or use of personal data, including (i) appropriate administrative, technical and physical safeguards and other security measures designed to ensure the security and confidentiality of the personal data it manages; (ii) a security design intended to prevent any compromise of its own information systems, computer networks or data files by unauthorized users, viruses or malicious computer programs; (iii) appropriate internal practices including, but not limited to, encryption of data in transit; using appropriate firewall and antivirus software; maintaining these countermeasures, operating systems and other applications with up-to-date virus definitions and security patches so as to avoid any adverse impact to the personal data that it manages; appropriate logging and alerts to monitor access controls and to assure data integrity and confidentiality; permitting only authorized users access to systems and applications; and (iv) all persons with authorized access to personal data must have a genuine business need-to-know prior to access (“Security Program”). The servers we use belong to the top, highly reputable company, and are physically located in the European Union, in particular in France, which the Customer is aware of and fully accepts.

We have implemented a lot of technical, organizational, and administrative solutions to help ensure the security of personal data.

Our servers are in the European Union.

Your account and organizational chart built on your data is protected by an encrypted password.

We keep your account secure, but you must also keep it safe. Our employees may not access your account unless required to fulfill a specific job.

Ways to control display and use of your information

Information Provided by You

Our goal is to give you simple and meaningful choices over your information. If you have a Network Perspective account, many of the choices you have on Network Perspective are built directly into the product or your account settings. For example you can at any time:

  • change your mind and opt not to disclose information, however for technical reasons you may then be unable to use certain features of Services and with no effect to previous processing;
  • correct, amend, add or delete personal data i.a. in your profile and contacts pages. You are the person that puts, changes and deletes information from our application or website;
  • close your account. When you close your account, we’ll deactivate it and remove your pins and boards from Network Perspective. We may retain archived copies of your information for benchmarks as well as required by law or for legitimate business purposes (including help to address fraud and spam) or if you ask us to do so.

Basically:

We give you a tool for gathering and analyzing information about your company and employees, so your data is only yours.

You are the owner of your data. Thus, at any time, you can add, change, or delete information.

Technical Information

You shall have choices available to you through the device or software you use to access Network Perspective. For example:

  • the browser you use shall provide you with the ability to control cookies or other types of local data storage;
  • your mobile device may provide you with choices around how and whether location or other data is shared with us.

To learn more about these choices, please see the information provided by the device or software provider. The "help" button of the toolbar on the majority of browsers will direct you on how to prevent your browser from accepting new cookies, how to command the browser to tell you when you receive a new cookie, or how to fully disable cookies. We recommend that you leave the cookies activated because cookies allow you to use some of Network Perspective's coolest features. Some of our business partners, like our advertisers, may use cookies on our website. We have no access to, or control over, these cookies.

Basically:

To remember you, our website will give you a cookie, which is completely safe. Third-party services that help us analyze how our site is utilized also use cookies to collect information about visitors. This applies only for the website, and not for the application. However, you can choose among web browsers and prevent your selected browser from accepting new cookies.

How we care about the security of your data

Customer Data

Customer represents and warrants that it has secured all rights in and to Customer Data. Customer grants Network Perspective a perpetual, irrevocable and royalty-free right to access, use, process, copy, distribute, perform, export and display Customer Data, only to the extent permitted by law and as reasonably necessary (a) to provide, maintain and improve the Services; (b) to prevent or address service, security, support or technical issues; (c) create de-identified data aggregated for benchmarking and marketing purposes in accordance with the Privacy Policy or (d) as otherwise expressly permitted by Customer. This right continues with respect to the de-identified data derived from Customer Data and any residual backup copies of Customer Data made in the ordinary course of business even after Customer stops using the Services. Network Perspective retains the right to delete any copies of such Customer Data.

Basically:

We know that your company's data is of great value. The security of your data determines the quality of our company. Therefore, we think a lot about the security of your data and use it only for unidentified comparative tests or other required services (e.g. backup).

Anonymity and Confidentiality

Customer acknowledges and agrees that its right to possess Customer Data and Network Perspective’s ability to show or transfer the Customer Data to Customer is subject to the degree of anonymity and confidentiality set by Network Perspective or specified by each Survey Respondent, as applicable.

Basically:

By default, the organizational charts you build with us include the sum of information displayed on the business cards of your company employees. If you decide that’s too much data, you determine which information and in what form data should be used and transformed by our tool.

Protection of Customer’s Data

Network Perspective shall store and process the Customer Data in a manner consistent with industry security standards. Network Perspective has implemented technical, organizational and administrative systems, policies, and procedures as well as other measures detailed in the Privacy Policy to help ensure the security, integrity and confidentiality of Customer Data and to mitigate the risk of unauthorized access to or use of Customer Data. Nonetheless, Customer acknowledges and agrees that hosting data online involves risks of unauthorized disclosure, loss or exposure and that, in accessing and using the Network Perspective application or website, Customer accepts such risks. To the extent authorized by law, Network Perspective offers no representation, warranty or guarantee that Customer Data shall not be subject to unauthorized use or disclosure. At times things can go wrong and the data are lost, once you let us know via e-mail support@networkperspective.io, we will recompense you and reduce the amount of your monthly subscription described in section named “Fees for Services”.

Basically:

We regularly make backups, but you will also export your data or use our API to make a backup on your own. Due to so many situations and circumstances, we cannot take responsibility for loss of data. In the event of a problem, however, we will reduce your fee for using the application.

Disclosure of Customer Data

Unless it receives Customer’s prior consent, Network Perspective shall not intentionally grant any third party access to Customer Data, except to Network Perspective’s third party services providers in connection with the performance or the improvement of the Services or in accordance with the Privacy Policy. Before sharing any Customer Data with any of its third party service providers, Network Perspective will ensure that the third party maintains reasonable data practices for maintaining the confidentiality and security of Customer Data and preventing unauthorized access. Notwithstanding the foregoing, Network Perspective may disclose Customer Data as required by applicable law or by proper legal or governmental authority or in accordance with the Privacy Policy.

Basically:

Your data is shared only with (a) users you indicate, (b) carefully chosen third party service providers to make the tool work, and (c) governmental authorities, only if we are obliged.

Utilization of Data

Customer acknowledges and agrees that to the extent permitted by law, the aggregated data derived from telemetric information and data related to how Users access and use the Website and the Network Perspective application (including, but not limited to, feature and function of the Website and the Network Perspective application being used by Users) is owned by Network Perspective and does not constitute Customer Data.

Basically:

To improve functionality, we gather aggregated information on how users access and use the application. We treat these data as related to our systems, not your company.

What will happen when your data are put on risk?

Network Perspective shall immediately notify Customer of any reasonably suspected or actual loss of data or breach or compromise of its Security Program which has or may result in the loss or unauthorized access like hacker attack, disclosure, use or acquisition of Customer’s Personal Data (including hard copy records) or otherwise presents a potential threat to such information (“Data Incident”). While the initial notice may be in summary form, a comprehensive notice shall be given within 48 hours to Customer. The notice shall summarize in reasonable detail the nature and scope of the Data Incident and the corrective action already taken or to be taken by Network Perspective. Network Perspective shall promptly take all necessary and advisable corrective actions, and shall cooperate with Customer in all reasonable efforts to mitigate the adverse effects of Data Incident and to prevent its recurrence.

Basically:

Although it has never happened, there is always the chance that a system malfunction or data breach could occur, putting your data at risk. If this unlikely event occurs, we will inform you within 48 hours about such an incident and the already-taken corrective actions.

Non-disclosure agreement (NDA)

Confidential Information

“Confidential Information” means a non-public, confidential and sensitive information: economical, legal, hr, organizational, technical, know-how, data of your company, including Customer Data, organizational charts, disclosed by a party (the “Disclosing Party”) to the other party (the “Receiving Party”) with a “Confidential” clause and excludes any information that is: (i) subject to applicable data protection laws, publicly available or later becomes publicly available other than through a breach of Privacy Policy; (ii) known to the Receiving Party or its employees, agents or representatives prior to such disclosure or is independently developed by the Receiving Party or its employees, agents or representatives subsequent to such disclosure; or (iii) subsequently lawfully obtained by the Receiving Party or its employees, agents or representatives from a third party without obligations of confidentiality, (iv) used as a benchmark.

Basically:

We handle your data, especially confidential information, really seriously.

Use or Disclosure of Confidential Information

The Receiving Party shall only use or disclose Confidential Information to exercise its rights and fulfill its responsibilities under the Agreement. The Receiving Party shall exercise the same degree of care and protection with respect to the Confidential Information that it exercises with respect to its own confidential information and in any event, at least diligent and prudent care. The Receiving Party shall not directly or indirectly disclose, copy, distribute, republish, or allow any third party to have access to any Confidential Information, except that Network Perspective may disclose Confidential Information to its employees and third party services providers in connection with the performance or the improvement of the Services, in which case Network Perspective will ensure that the third party maintains reasonable data practices for maintaining the confidentiality and security of the Confidential Information and preventing unauthorized access. Notwithstanding the foregoing, the Receiving Party may disclose Confidential Information as required by applicable law or by proper legal or governmental authority.

Basically:

We will use the same high level of security and care with respect to your data as with our own confidential data.

How do we make changes to this policy?

Network Perspective will review and update its policies and procedures as required to keep up to date with rules and regulations, new technologies, standards and Customers concerns. This Policy may therefore change from time to time (see “Amendments” in Terms of Service).

Basically:

Because standards and protection technologies change frequently, we can change the Privacy Policy without prior notice.
